Defamation Suit Stemming from NPDB Report: Did you know that a provider may file a defamation suit against an entity that files a report to the National Practitioner Data Base (NPDB)? A federal district court held that a Chicago doctor may proceed with a suit alleging that his former employer filed a false NPDB report that contained “false and malicious” statements about him being an “immediate threat to the health or safety” of patients. The court also held that the doctor was not required to exhaust the administrative remedy provided to him by the federal regulations for disputes stemming from an NPDB report.
Virginia’s Independent ObamaCare Exchange: Did you know that the State Corporation Commission of Virginia (SCC) has released a request for proposals for the State-Based Exchange Technology Platform (SBE Platform) and Consumer Assistance Center? This is the next step for Virginia to transition from HealthCare.gov to a fully autonomous Virginia-based health insurance exchange. SCC plans to complete the transition by fall of 2023, in time for Open Enrollment for health plans that begin coverage January 1, 2024.
