Nursing Home Ownership: Did you know that the Centers for Medicare and Medicaid Services has published its final rule requiring skilled nursing facilities (SNFs) to disclose detailed information about ownership? SNFs are now required to use revised Form CMS-855A (09/23 version). The new form requires more ownership information, including checkboxes for private equity companies and real estate investment trusts. 

Lab-Developed Tests: Did you know that the FDA published a final rule on May 6, 2024, that gives the agency clear authority to regulate medical tests that are created by single laboratories, known as lab-developed tests (LDTs)? LDTs will be considered medical devices and be regulated under the Federal Food, Drug, and Cosmetic Act. LDTs include tests for COVID-19, among other infection and disease testing. The final rule contains a phase-in period of four years after which the FDA will expect laboratories to comply with premarket review requirements for certain LDTs.

Overtime Pay Exemption: Did you know that the Department of Labor (DOL) issued a final rule that significantly raises the salary requirements for businesses to classify certain employees as exempt from the requirement to pay the employee overtime pay? The current salary requirements to avoid overtime pay for certain executive, administrative and professional employees is $684 per week ($35,568 annually) which is increasing to $844 per week ($43,888 annually) starting July 1, 2024, and then increasing to $1,128 per week ($58,656 annually) beginning January 1, 2025. The final rule includes automatic increases every three years beginning July 1, 2027.
